Recent confrontations between constitutional courts and parliamentary majorities in several European countries have attracted international interest in the relationship between…
the judiciary and the legislature. Some political actors have argued that courts have assumed too much power and politics has been extremely judicialized. This volume accurately and systematically examines the extent to which this aggregation of power may have constrained the dominant political actors’ room for manoeuvre. To explore the diversity and measure the strength of judicial decisions, the contributors to this work have elaborated a methodology to give a more nuanced picture of the practice of constitutional adjudication in Central and Eastern Europe between 1990 and 2020. The work opens with an assessment of the existing literature on empirical analysis of judicial decisions with a special focus on the Central and Eastern European region, and a short summary of the methodology of the project. This is followed by ten country studies and a concluding chapter providing a comprehensive comparative analysis of the results. A further nine countries are explored in the counterpart volume to this book: Constitutional Review in Western Europe: Judicial-Legislative Relations in Comparative Perspective. Unlike many of their European counterparts that have made significant electoral gains up to and including participation in national governments, the Australian far-right parties of the ‘fourth wave’ have experienced relatively poor electoral results. But this does not necessarily mean that Australia is uniquely hostile to far-right politics. Focusing particularly on the 2019 Australian federal election, this book takes an organisational approach to better understand why Australian far-right parties struggle electorally. Through the novel lens of disorganised parties, the author argues that the failure to develop a functioning party organisation has resulted in Australian far-right parties being unable to effectively navigate their political environment. By focusing on disorganisation, this book provides a new perspective for understanding the limited electoral impact of the far right in Australia today, despite favourable conditions like normalised Islamophobia and growing dissatisfaction with mainstream parties. The international activity of the OUN is examined through the cooperation with individual countries, including Lithuania, Czechoslovakia, and Germany, but also with lobbying efforts in Great Britain, France, Italy, and North America, where émigré activists of the OUN or their contacts were based. This book argues that the guidelines of SSR have always tended to draw on theoretical work in the field of CMR and focus too heavily on Western, liberal democratic models of governance. Consequently, reform programs based on these guidelines, and intended for use in post-conflict and conflict-affected states, have had, at best, mixed results. The book challenges the necessity for this over-reliance on traditional Western liberal democratic solutions and instead advocates an alternative approach. It proposes that by drawing on an unconventional CMR model, that in turn references the specific context and cultural background of the particular state being subject to reform, there is a significantly higher chance of success. The book opens with Kovic’s never-before-revealed Vietnam diary (July 7, 1967–July 26, 1968). His entries from this period portray a patriotic young soldier with a strong moral and religious conscience.
