This book focuses on the testimonial evidence of traumatised witnesses in trials of international crimes, which deal with acts of…
genocide, war crimes and crimes against humanity. Such trials often involve the testimonies of those who experienced or witnessed extremely traumatic events, which can make it hard for these witnesses to recall specific details. Testifying during trial may in itself also pose challenges to their well-being. Yet the legal process of determining whether someone can be held criminally responsible for the alleged crimes needs to be fair, in accordance with the right to a fair trial of the accused, and the facts need to be determined as accurately as possible. This book argues that to ensure fair and accurate fact-finding when in particular traumatised witnesses testify, a balance needs to be struck between the needs of witnesses who testify about traumatic experiences, the fair trial rights of the accused and the objective of the court to establish as accurately as possible the responsibility of the accused. This is crucial throughout the stages of selecting, preparing, presenting and assessing the testimonial evidence of traumatised witnesses. The methodology involves an analysis of transcripts of proceedings and case law of the International Criminal Tribunal for the former Yugoslavia, the International Criminal Court and Dutch courts prosecuting international crimes. The research demonstrates that it is often difficult to strike a balance between the competing objectives during proceedings when traumatised witnesses testify due to the current lack of regulations and guidelines applicable during investigations and prosecutions. This book shows that this balance can, and should, be achieved when traumatised witnesses testify during criminal proceedings for international crimes. The work is an invaluable resource for researchers, academics and practitioners in criminal law, criminology, legal psychology, legal psychiatry, social anthropology and forensic sciences.Restorative Justice at a Crossroads: Dilemmas of Institutionalisation (Routledge Frontiers of Criminal Justice)

Par Thomas Joiner. 2024
Argues that a range of behaviors such as murder-suicide, terrorism, and mass shootings are better understood as motivated by suicidal…
impulses than by homicidal onesMass shooters often display behaviors that strongly mirror the warning signs for suicide: lives led in isolation, intense personal suffering, disaffection, and struggle. Letters detailing why they did what they did paint pictures of intense misery and loneliness. As this book makes clear, private despair sometimes leads to social violence. In this groundbreaking work, Thomas Joiner offers a unified theory of suicide, making the case that many acts that appear homicidal are best understood primarily as suicidal. We must recognize that there are several forms of suicidal violence, some of which masquerade as other types of acts, including terrorism and murder. These include suicide-by-cop, suicide terrorism, murder-suicide, and running amok. Though there are obvious differences among these acts, Joiner argues that framing them as stemming from a common ideology of suicide is a crucial step in preventing these atrocities.By recognizing the desire to die—not to kill—as being at the heart of many of the acts of those who choose to kill their partner, shoot up their school, or terrorize their community, we can offer more effective measures of intervention. At a time when our nation is scrambling for solutions in the fight to end gun violence, this book presents a crucial component in the detection and treatment of unwell individuals.Juvenile Justice: Theory and Practice

hot spots, patterns, and rhythms: drug dealers work their markets, prostitutes stroll their favorite corners, and burglars hit their favorite neighborhoods. But putting all the geographic information together in cases of serial violent crime (murder, rape, arson, bombing, and robbery) is highly challenging. Just ask the homicide detectives of the Los Angeles Police Department who hunted the Hillside Stranglers, or law enforcement officers in Louisiana who tracked the brutal South Side rapist.Geographic Profiling introduces and explains this cutting-edge investigative methodology in-depth. Used to analyze the locations of a connected series of crimes to determine the most likely area of offender residence, geographic profiling allows investigators and law enforcement officers to more effectively manage information and focus their investigations. This extensive and exhaustive work explains geographic profiling theories and principles, and includes an extensive review of the literature and research in the areas of criminal profiling, forensic behavioral science, serial violent crime, environmental criminology, and the geography of crime. For investigators and police officers deployed in the field, as well as criminal analysts, Geographic Profiling is a "must have" reference. Those who know about how spirituality plays into the world of drug smuggling have likely heard of Santa Muerte, Jesus…
