Ecology and Environmental Ethics: Green Wood in the Bundle of Sticks (Routledge Revivals)
Par Robert Jay Goldstein. 2004
Originally published in 2004. Examining the successes and failures of three decades of environmental law, this absorbing book reconsiders some…
of the policies devised to remedy centuries of abuse of the planet. It acknowledges the advances made using technological standards to effect pollution control as well as rudimentary systems that regulate use of land at the local level. However, as the author observes, these systems have limitations in solving vexing problems such as sprawl and non-point source pollution, as the cost of their use can easily outweigh the benefits. He suggests a system, termed 'Green Wood in the Bundle of Sticks', that provides the necessary theoretical and historical bases to bridge the gap between the potentials of each system. Using objective criteria based on science, this system is tied to a land ownership system that also takes into account societal concerns at a broader level.Private Law, Nudging and Behavioural Economic Analysis: The Mandated-Choice Model (Markets and the Law)

without ignoring personal autonomy. It suggests that the dilemma between inefficient opt-in rules and autonomy restricting opt-out schemes fails to realistically capture the span of options available to the policy maker. There is a third path, namely the ‘mandated-choice model’. The book is mainly dedicated to presenting this model and exploring its great potential. Contract law, consumer protection, products safety and regulatory problems such as organ donation or excessive borrowing are the setting for the discussion. Familiarising the reader with a hot debate on paternalism, behavioural economics and private law, this book takes a further step and links this behavioural law and economics discussion with philosophical considerations to shed a light on modern challenges, such as organ donation or consumers protection, by adopting an openly interdisciplinary approach. The book will be of interest to students and scholars of contract law, legal systems, behavioural law and economics, and consumer law.Written by the nation's foremost authority on gunshot wounds and forensic techniques as they relate to firearm injuries, this third…

The book describes practical aspects of ballistics, wound ballistics, and the classification of various wounds caused by handguns, rifles, and shotguns. It also explains autopsy techniques and procedures and laboratory analyses relating to weapons and gunshot evidence. A much-needed update after nearly 20 years, the third edition of Gunshot Wounds provides the latest and most thorough information on firearms and best practices for examining firearm-related wounds. This book explores the role of trade remedies in liberalising environmental trade and discouraging environmentally harmful trade. As trade remedies…
can pose a significant obstacle to environmental trade, this book outlines how trade negotiators can implement restrictions on the application of trade remedies on environmental goods. It also assesses whether and how investigating authorities can account for differences in environmental protection standards in trade remedy investigations and considers what a possible 'trade remedy' for environmental harm might look like. Although the book concludes that trade remedies will remain a trade instrument primarily driven by economic and competitiveness concerns, it demonstrates how environmental considerations can guide trade remedy policy, how investigating authorities can properly account for the environmental costs of production, and how the limited policy space available in the WTO Agreements on Trade Remedies can be used to pursue green policy goals. This book offers a comprehensive introduction to French contract law with a focus on the role of consent and the…
evolution of consensualism, considering its immediate historical sources. The book provides a clear, in-depth, and analytical discussion of the contingency of consensualism and how the development of consensual ideas across time and transnational geographical settings has specifically underpinned modern French contract law, which has inspired other legal systems and continues to do so. It also challenges the macro-narratives of European legal history and redefines consensualism so that it may be properly understood, addressing its manifest contemporary misinterpretations. Thorough, engaging, well-structured and inventive, there is no other English-language scholarly work that offers a similar analysis.“This monograph makes an evident contribution to the field by offering an original interpretation of several provisions in the Code Civil which relate to the law of contract. The author demonstrates an impressive grasp of Latin, French and English sources as well as knowledge of Roman law, legal history, and contemporary French law. It is well-referenced and offers an extensive bibliography”. – Dr Stephen Bogle, Senior Lecturer in Private Law, University of Glasgow, UK“The author brings a critical perspective to bear throughout the monograph and develops a clear and quite sophisticated position on the interaction between consensualism and formalism in Roman and French law and the intervening European ius commune”. – Prof Hector MacQueen, Emeritus Professor of Private Law, University of Edinburgh, UKCorporate Liability and International Criminal Law
Par Alessandra De Tommaso. 2024
This book investigates whether corporate criminal liability should be incorporated within the scope of international criminal law. The work provides…
unique insight into the evolution of the debate on the international criminal liability of corporations to facilitate future discussion on the possibility of including corporations within the scope of international criminal law. It combines a detailed examination of Nuremberg and Rome with the examination of previously overlooked initiatives such as the Draft Code of Offences against Peace and Security of Mankind and the 1951 and 1953 Committees on International Criminal Jurisdiction. This analysis is also complemented by a review of significant post-1998 international and domestic developments around corporate criminal liability. In addition, it offers suggestions for the development of an amendment to hold corporations accountable under the Statute of the International Criminal Court. This book contributes to the existing literature on the topic of corporate liability which attracts significant attention from scholars in the fields of Law, Business, and Political Science. It will be useful to professionals in the academic and diplomatic fields, researchers, legal advisors, and business leaders. It will also be of interest to anyone who wants to understand the debate on holding businesses accountable under international criminal law.World Criminal Justice Systems: A Comparative Survey
Par Richard J. Terrill. 2023
The revised tenth edition of this core textbook provides an understanding of major world criminal justice systems by discussing and…
comparing the systems of six of the world’s countries—each representative of a different type of legal system. England, France, Japan, South Africa, Russia, and China are all covered in detail, and an additional chapter on Islamic law uses three example nations to illustrate the range of practice within Sharia. Political, historical, organizational, procedural, and critical issues confronting the justice systems are explained and analyzed. Neatly organized with a parallel structure throughout the text, each chapter contains material on government, police, judiciary, law, corrections, juvenile justice, and other critical issues. A new feature of this text focuses on the nature of the political world order and the significant clash between some democratic and authoritarian governments. Of particular concern are those authoritarian governments that have seen the rise of what has been popularly referred to as the strongman leader. The countries covered in this text have seen the emergence of four such strongmen. While the rise of each occurred in different contexts, they were each facilitated in significant ways by the manner in which they asserted their control over the country’s criminal justice system. This book is suitable for undergraduate and graduate students in criminal justice, prelaw, and similar programs. Supplementary materials for instructors include test bank and lecture slides.Proceedings of the Fourth International Conference on Administrative Science (Advances in Social Science, Education and Humanities Research #776)

This book seeks to emphasize the fundamental structure and methods of legal drafting, which, the authors contend, are grounded in…
a surprisingly few, elemental rules and techniques of legal analysis and deployment of legal authorities amid relevant facts. It is designed to help the novice legal drafter identify those elemental rules and techniques and show how they are used to prepare effective legal writing in different formats, most of which share common elements and structures. The book begins with a discussion of legal analysis, followed by a discussion of general drafting principles and rules, and then proceeds to apply these concepts in the following chapters to specific forms of legal writing including client letters, demand letters, research memoranda, motions and supporting documents, appellate briefs, contracts and instruments, and legislation. It closes with a chapter on "writing to build a record" that reprises the other chapters and highlights the key concepts.Dieser Band enthält Beiträge führender Steuer-, Verfassungs- und Europarechtswissenschaftler zu aktuellen Fragen des Europäischen Steuerverfassungsrechts. the deteriorating ecological health of the planet. Modern agricultural practices promise to maximise the productive efficiency of available land but are one of the main drivers of agro- and biodiversity loss. Agroecology, which places ecological sustainability and diversity at the heart of agriculture, is one response to these challenges. It presents agriculture not only as the process through which food is produced, but as a dynamic socioecological phenomenon that exists through networks comprising natural and human stakeholders at global, national and subnational levels. Drawing on a combination of agroecological and legal literature, this book explores where there is space in international law to pursue agroecology. Using a range of case studies, it demonstrates how concepts, mechanisms and regulatory approaches in the law advance, and can be reformed to further advance, an agroecological legal framework that allows humanity to meet its agricultural needs in a way that protects the natural and cultural diversity that is fundamental to the ecological integrity of the planet.Shipping Performance Management (Lloyd's Practical Shipping Guides)

Par Cornelia Woll. 2023
The geopolitics of American law enforcement and how it changed corporate criminal accountability in other countriesOver the past decade, many…
of the world’s biggest companies have found themselves embroiled in legal disputes over corruption, fraud, environmental damage, tax evasion, or sanction violations. Corporations including Volkswagen, BP, and Credit Suisse have paid record-breaking fines. Many critics of globalization and corporate impunity cheer this turn toward accountability. Others, however, question American dominance in legal battles that seem to impose domestic legal norms beyond national boundaries. In this book, Cornelia Woll examines the politics of American corporate criminal law’s extraterritorial reach. As governments abroad seek to respond to US law enforcement actions against their companies, they turn to flexible legal instruments that allow prosecutors to settle a case rather than bring it to court. With her analysis of the international and domestic politics of law enforcement targeting big business, Woll traces the rise of what she calls “negotiated corporate justice” in global markets.Woll charts the path to this shift through case studies of geopolitical tensions and accusations of “economic lawfare,” pitting the United States against the European Union, China, and Japan. She then examines the reactions to the new legal landscape, describing institutional changes in the common law countries of the United Kingdom and Canada and the civil law countries of France, Brazil, and Germany. Through an insightful interdisciplinary analysis of how the prosecution of corporate crime has evolved in the twenty-first century, Woll demonstrates the profound transformation of the relationship between states and private actors in world markets, showing that law is part of economic statecraft in the connected global economy. When international courts are given sweeping powers, why would they ever refuse to use them? The book explains how and…
when courts employ strategies for institutional survival and resilience: forbearance and audacity, which help them adjust their sovereignty costs to pre-empt and mitigate backlash and political pushback. By systematically analysing almost 2,300 judgements from the European Court of Human Rights from 1967–2016, Ezgi Yildiz traces how these strategies shaped the norm against torture and inhumane or degrading treatment. With expert interviews and a nuanced combination of social science and legal methods, Yildiz innovatively demonstrates what the norm entails, and when and how its contents changed over time. Exploring issues central to public international law and international relations, this interdisciplinary study makes a timely intervention in the debate on international courts, international norms, and legal change. This book is available as Open Access on Cambridge Core. The Aarhus Convention: Towards Environmental Solidarisation (Environmental Politics and Theory)
Par Duncan Weaver. 2023
The Aarhus Convention on access to information, public participation in decision-making and access to justice in environmental matters has been…
celebrated as a pioneering international environmental agreement. Given that a quarter-century has passed since Aarhus was opened for signature, now is an opportune moment to revisit it from a fresh perspective. Marking this anniversary, this book explores Aarhus from the vista of the English School of International Relations, an ethically-minded perspective used to gauge the prevalence of state-oriented and human-oriented progress from the Convention's rationales and realities. It firstly considers Aarhus' propagation, investigating the legal, diplomatic and geopolitical contexts enabling its emergence. It secondly investigates Aarhus' germination, with reference to its trinity of procedural rights. Thirdly, the book examines the Convention's growth, in terms of the development of its organisational infrastructure. The chief finding is that Aarhus demonstrates, in environmental contexts, the feasibility and benefit of fostering 'humankind' solidarist progress, rooted in moral cosmopolitanism, within the existing power arrangements of a sovereignty-based pluralism. Pluralist concerns for diversity and international order are found to be a precondition for more ethically ambitious solidarist endeavours. These observations reinforce the logic of solidarisation, an English School innovation that presents sovereignty as (a) being ethically matured by solidarism whilst (b) delimiting solidarism within the threshold of states' tolerance.Space Criminology: Analysing Human Relationships with Outer Space (Palgrave Studies in Green Criminology)
